SHOPPING ONLINE

To shop with us, you must have completed Mikka’s Jewellery’s registration process.  Upon registration, you will be asked to choose a password.  Please keep it secret, as you are entirely responsible if you do not maintain its confidentiality.  You are also entirely responsible for all activities that occur under your user id ASD PASSWORD.  By shopping on this website, you acknowledge that you have read, understood and agree to be bound by our terms and conditions.

If Mikka’s Jewellery reasonably believes that you are providing untrue, inaccurate or incomplete information, we may choose to suspend or terminate your user ID.  Mikka Jewellery will not be liable to you for any loss or damage arising from your failure to maintain the confidentiality of your password. Mikka’s Jewellery will always protect any information given by you and will not share any information with any third party.

 

PLACING OF ORDERS

Any orders that you place will be by way of transaction via the Mikka’s Jewellery website.

Only persons aged 18 years and over, who are legally entitled to do so, are permitted to place orders with Mikka Jewellery.

By placing an order, you represent and warrant that:

You are legally capable of entering into binding contracts;

You are at least 18 years of age; and

You agree to be bound by these terms and conditions.

This Agreement shall be governed by and interpreted according to the laws of the Republic of South Africa and, in the event of any conflict between or inconsistency in the laws applicable in the various provinces of the Republic of South Africa, the law as applied and interpreted in the Province of Gauteng will prevail.

All jewellery displayed on our Website are subject to availability.  All prices shown on our website are quoted in South African Rands and are valid and effective only in the Republic of South Africa.  We reserve the right to discontinue or change the specifications of our products from time to time without notice.  We will inform you as soon as possible if any products ordered by you are not available. Risk in the jewellery shall pass to you or your authorized representative on delivery.  We will retain ownership in the products until payment has been received in full.

You are responsible to order the correct size of jewellery.  Eg. Bracelets, chains ,bangles and necklaces will have lengths and thickness allocated. Please make sure you order correct size. Once an order is placed, a no exchange policy exists, unless you return the jewellery in an unopened and fully sealed package within 5 days of placing the order. Please send an email as soon as you receive the package and include a photo of why you want to return the product.  You are only eligible for a refund if the jewellery is returned in the original packaging that is subject for an internal inspection.

If you paid using another payment method, by electronic funds transfer (EFT), to your bank account.  For this purpose you may be required to provide your bank account details to Mikka’s Jewellery.  EFT payments takes 14 working days to process. All returns must be sent via a courier with a waybill number as Mikka’s Jewellery will not be responsible for any lost postage.

Return of defective jewellery:
If the Jewellery purchased has a material defect, not caused by everyday wear and tear, you may send a mail with a photo to info@mikkasjewellery.co.za of the defective piece within 3 months. If it is found that the piece is defective due to wear and tear no replacements will be done. If It is a material defect the piece will be replaced or refund given if that particular piece is not in stock.

 

Returns:
No Earrings will be exchanged due to hygienic reasons. Make sure you order the right size.

PAYMENT

You can pay with Payfast and electronic funds transfer payments, Authority of payment is given at the time of order, followed by a debit once the order has been redeemed.  All prices include VAT  unless otherwise stipulated. You can pay via  Internet transfer into our bank account, after which your proof of payment must be emailed as proof of payment with your order number as reference.  Please note that orders paid for via  Internet transfer are subject to a 3 working day clearing policy and the order will only be manufactured thereafter.

Funds Refund upon Cancellation after payment is made:

Only refund via EFT

Any Bank Fees will be taken from the amount paid by Client as Mikka’s Jewellery cannot be liable for EFT banking fees paid back to you

NO Refunds will be made if Client paid via PAYFAST with credit card or EFT or INSTANT Payment.

 

DELIVERY

Delivery will only be made to the delivery address selected, and only to physical addresses.  Fastway Courier Services will deliver during business hours (8am – 5pm) on weekdays and will not call beforehand to arrange a time for delivery.  If no one is on hand at the time of delivery, they will attempt again the following day.  Thereafter the parcel will be redirected to Mikka’s Jewellery, who will then contact the customer to clarify delivery details.  In such a case, a redelivery fee may be charged at our discretion.

For main city centres, please allow 24 – 48 hours’ turnaround time for delivery from the date of dispatch. If delivery cannot take place as the parties endeavoured, then the failed delivery on the date and time indicated shall not allow for the cancellation of the sale.  The purchaser irrevocably waive the right to claim cancellation as a result thereof. Items with a manufacturing defect and a return authorization code may be returned within 5 working days of the date of receipt.  Please notify your customer service department, who will inform you of the procedure to return the item.

 

LIABILITY

Although we will offer you the best service we possibly can, we make no promise that our online shopping services will entirely meet your requirements, or that the service will be uninterrupted, timely or error free.

 

DISCLAIMER

Apart from the provisions of sections 43(5) and 43(6) of the electronic Communications and Transactions Act, neither Mikka’s Jewellery nor any of its agents or representatives shall be liable for any damage, loss or liability of whatsoever nature arising from the use or inability to use the website, the services or the content provided from and through this website.

Furthermore, Mikka’s Jewellery makes no representations or warranties, implied or otherwise, that amongst others, the content and technology available from this website are free from errors or omissions, or that the service will be 100% uninterrupted and error free.

This website is supplied on an “as is” basis and has not been compiled or supplied to meet the user’s individual requirements.  It is the sole responsibility of the user to satisfy itself prior to entering into this agreement with Mikka’s Jewellery that the service available from and through this website will meet the user’s individual requirements and be compatible with the user’s hardware and/or software.

Information, ideas and opinions expressed on this website should not be regarded as professional advice or the official opinion of Mikka’s Jewellery, and users are encouraged to consult professional advice before taking any course of action related to information, ideas or opinions expressed on this website.  Neither Mikka’s Jewellery nor any of its agents or representatives shall be liable for any damage, loss or liability of whatsoever nature arising from the use or inability to use any product sold on this website.

 

CARING FOR SILVER

Remember to store your jewellery in a safe and secure place.  Avoid dust, moisture and direct light to ensure your jewellery does not tarnish and discolour.  When wearing, simply follow the golden rule “Last on/First off”.  Put jewellery on last so that it is not sprayed with perfumes and hairspray.  Take it off first before your clothing and before going to bed to avoid it be snagged or crushed. Never sleep, bath or swim with your jewellery.  Chains may kink, earing posts may bend, and contact with water, especially chlorinated or salt water is especially damaging to silver.

Sterling Silver may tarnish and oxidise.  This is a natural reaction to chemicals in the atmosphere, heat and the body oils of the wearer.  Discolouration can usually be removed by careful use of good quality jewellery cleaning cloth.  Contact with perfume, hairspray, chlorinated or salt water or household cleaning products should always be avoided.  Silver is a malleable (soft) metal; therefore be gentle with earing posts, clasps etc. as they can bend or break under excessive force.  Gemstones can also scratch, crack or chip if dropped.

Always clean your sterling silver jewellery with approved commercial sterling silver cleaner. Make sure to read direction for use as Mikka’s Jewellery will not be liable for damage to incorrect use. We cannot cover wear and tear over time and negligence.  Jewellery treated with care will give many years of pleasure and enjoyment.

If you have Sterling Silver with gemstones, do NOT use the sterling Silver cleaner on the stones. The stones may get damaged.

Any Sterling Silver Jewellery that gets severe corrosion is not fault of Mikka’s Jewellery as I only sell 925 Sterling Silver and nothing Plated. So any corrosion/discoloration is the owner of the Jewellery’s responsibility in the caring and handling of his/her Jewellery and Mikka’s Jewellery will not be held responsible and no exchanges will be made.

 

CONSUMER PROTECTION ACT

Nothing in these terms and conditions of sale:

limits or exempts Mikka Jewellery from any liability (including liability for any loss directly or indirectly attributable to Mikka Jewellery gross negligence or that any person acting for, or controlled by Mikka Jewellery to the extent that the law does not allow this; or requires the Customer to assume risk or liability for this kind of loss to the extent that the law does not allow this.

If these terms and conditions of sale, and/or any products provided under these terms and conditions of sale, is regulated by the Consumer Protection Act, 68 of 2008, as amended, it is not intended that any provision of these terms and conditions of dale contravenes any provision of that Act.  Therefore, all provisions of these terms and conditions of sale must be treated as being qualified, to the extent necessary, to ensure compliance with the provisions of that Act.

 

INDEMNITY

Mikka’s Jewellery is responsible for adhering to the Consumer Protection Act 68 of 2008 (“CPA”) with the sale of any products from the site.  Similarly, Mikka Jewellery is responsible for adhering to articles 43(5) and 43(6) of the electronic Communication and Transactions Act in terms of payment systems and security. However, neither Mikka Jewellery nor any of its representatives will be held responsible for any loss or accountability of any kind that arises from the use of (or inability to use) this site, its services or content.

Furthermore, Mikka Jewellery provides no guarantee, implied or otherwise that the content or technology attached to this website is free from errors or omissions.  Nor is there any guarantee whatsoever that service will be uninterrupted or faultless.  We encourage you to report any faults/problems. Although the products on the site may be under guarantee, the site itself is offered on an “as it is” basis and is not setup or delivered according to your individual specifications.

It is your responsibility, before accepting these terms and conditions, to determine the service available through this website satisfies your individual needs and is compatible with your hardware and software.  Information, ideas and opinions expressed on this website should not be regarded as professional advice, or as Mikka Jewellery’s official stance. We encourage you to obtain professional advice before taking any action on the strength of information, idea or opinions expressed on this site.

 

ENTIRE AGREEMENT AND NO REPRESENTATIONS

This Agreement comprises of the entire agreement between the parties in relation to its subject matter, and it supersedes any written or oral representations, be they express or implied, and any prior agreements between you and Mikka Jewellery.

No party shall be bound by any express or implied terms, representation, warranty, promise or the like not expressly recorded in this Agreement.

 

PROMOTIONS AND COMPETITIONS

Any winnings must be claimed within 36hrs after contact has been made or attempted to be made

By Mikka’s Jewellery with the chosen winner of that specific competition on www.mikkasjewellery.co.za or on Facebook

If the Person Chosen does not claim the winnings or promotion within 36hrs after contact has been made or attempted to be made by Mikka’s Jewellery, that person will forfeit their winnings and the next participant will be chosen.

To be able to claim a Physical Prize the Person That was Chosen as the Winner of that Specific Competition needs to provide a Full Address, full name and a Cellphone number as the Prize will be couriered to that person. No other Person will be able to receive the prize on His/Her behalf.

If the Information could not be provided the prize will be forfeited and a new Winner will be Chosen.
